THIS CONTEST IS OPEN TO CANADIAN RESIDENTS (EXCLUDING QUEBEC) ONLY
AND IS GOVERNED BY CANADIAN LAW.
HOW TO ENTER:
No purchase necessary. The contest begins on March 15, 2008 at 12:00:01 a.m. Eastern Time and ends on August 31, 2008 at 11:59:59 p.m. Eastern Time (the “Contest Period”). To enter the contest, fill in a ballot after purchasing chocolate covered almonds at participating retailers. To enter without purchase go to www.theholmesfoundation.com, click on “ Support the Trades” Fundraiser contest link, click on the “enter” button and an entry form will appear. Fully complete the entry form and submit your entry form on-line. Your entry must be received within the Contest Period. All eligible entries received during the Contest Period will be entered in the random draw. Limit one entry per person or email address permitted per day. If it is discovered that you attempted to enter more than once per day all your entries will be void. Entries will be rejected if entry form is not fully completed and submitted during the Contest Period.
ELIGIBILITY: This contest is open to all residents of Canada (excluding Quebec) who are over the age of 13 at the time of entry except employees (and those with whom such employees are domiciled) or agents of The Holmes Group (“the Sponsor”) or employees of Superseal Construction Products Ltd., their respective advertising and promotion agencies and the contest judges.
THE PRIZES AND APPROXIMATE RETAIL VALUE:
GRAND PRIZE: There will be one grand prize awarded consisting of a 2008 Chevrolet Malibu 4 door Hybrid . Approximate retail prize value is $29,000. License, insurance, registration, fuel and maintenance costs are the responsibility of the winner. Winner will take delivery of the vehicle from the Chevrolet dealership closest to the winner's home. The winner must have a valid driver's license and insurance. In the event an individual under the age of majority wins the vehicle, such individual's parent/legal guardian must accept the prize on their behalf and have a valid driver's license and insurance.
SECONDARY PRIZES: There will be ten (10) secondary prizes awarded, each consisting of one pair of Holmes Workwear overalls . Approximate retail value is $100 each. Prizes must be accepted as awarded and are not convertible to cash. No substitutions except at Sponsor's option. Sponsor reserves the right to substitute a prize or prize component with one of equal or greater value. Limit one prize per household.
DRAWS AND WINNERS SELECTION:
On October 17, 2008 in Toronto, Ontario at 11:00 a.m. (Eastern Time) eligible entrants will be selected by random draws from all eligible entries received. The first entrant selected will be eligible to win the grand prize and the next ten (10) selected entrants will be eligible to win a secondary prize. The odds of winning depend on the number of eligible entries received. Selected entrants (or such entrant's parent/legal guardian if a minor) will be contacted by phone or email. If a selected entrant cannot be contacted within fourteen (14) days of selection or there is a return of any prior notification as undeliverable, that entrant will be disqualified and an alternate entrant will be selected from among the remaining eligible entries. Before being declared a winner, each selected entrant must first a) correctly answer, unaided, a time-limited mathematical skill testing question to be administered by telephone at a prearranged mutually convenient time or email; b) sign a standard declaration and release form confirming compliance with the contest rules, acceptance of the prize as awarded and releasing the Sponsor, its advertising and promotion agencies, the contest judges and their respective officers, directors, agents, representatives, successors and assigns (the “Releasees”) from any liability in connection with this contest, the entrant's participation therein and/or the awarding and use/misuse of the prize or any portion thereof. If a selected entrant is a minor, such entrant's parent/legal guardian must sign and return the declaration and release form and accept the prize on his/her behalf. If a selected entrant (or such entrant's parent/legal guardian if a minor) cannot be contacted by email or telephone or fails to return the contest documents within the specified time, he/she will forfeit the prize and an alternate eligible entrant will be selected. This process will be repeated until all of the prizes are awarded.
GENERAL CONDITIONS:
By entering the contest, each selected entrant agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the contest and/or photograph or other likeness without further compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast or the Internet. The Sponsor, its advertising and promotion agencies and the contest judges are not responsible for late, lost, misdirected, delayed, incomplete or illegible ballots or entries.
Without limitation, the Sponsor, its advertising and promotion agencies and the contest judges will not be liable for any failure of the web site during the contest; for any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; for the failure of any entry or ballot to be received by the Sponsor, its advertising and promotion agencies or the contest judges for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any web site; or any combination of the above. Further, the Sponsor, its advertising and promotion agencies and the contest judges will not be liable for any injury or damage to an entrant's or any other person's computer related to or resulting from participating or downloading any material in the contest.
The Sponsor reserves the right to withdraw or amend this contest in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this contest as contemplated by these Rules. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
This contest is subject to all applicable federal, provincial and municipal laws. Void where prohibited by law. The decisions of the Sponsor and contest judges with respect to all aspects of this contest are final and binding on all entrants without right of appeal.
In the event of a dispute, online entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. If the identity of an online entrant is disputed, the authorized account holder associated with the email account at the time of entry will be deemed to be the entrant. A selected entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected entry name change. The sole determinant of the time for the purposes of a valid online entry in this contest will be the contest server machine(s).
The Sponsor reserves the right to cancel or suspend this contest in the event of any accident, printing, administrative, or other error of any kind without prior notice or obligation.
By entering this contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her entry only for the purpose of administering the contest and in accordance with Sponsor's Privacy Policy unless the entrant otherwise agrees. |
